Terms governing access to and use of the M&S Fence website.

1. Acceptance
By accessing or using mandsfence.com, you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the website.
2. Website information
The website provides general information about M&S Fence, its products and services. We try to keep information useful and current, but content may contain errors or become outdated. Website content is not professional engineering, legal, safety or code-compliance advice.
3. Quotes, orders and service agreements
A form submission, email or telephone inquiry does not create a reservation or binding agreement. Prices, quantities, specifications, deposits, delivery charges, rental periods, installation, removal and other terms must be confirmed by M&S Fence in a written quote, order, rental agreement or service agreement. If these Terms conflict with a signed or accepted written agreement for products or services, that agreement controls for the applicable transaction.
4. Availability and scheduling
Product availability, delivery timing, same-day or emergency service and project scheduling are subject to inventory, location, site access, weather, crew availability and confirmation by M&S Fence. Images are illustrative; actual products, finishes and configurations may vary.
5. Customer information and site responsibilities
You are responsible for providing accurate project, contact, access and site information. Unless a written agreement states otherwise, you are responsible for confirming property boundaries, underground and overhead utilities, permits, municipal requirements, site hazards, ground conditions, traffic or pedestrian controls and other project-specific legal and safety requirements. Do not rely on temporary fencing as a substitute for any barrier, guard or system required by law or a qualified professional.
6. Rental and purchased equipment
Possession, use, relocation, care, loss, damage, return and removal of rental equipment are governed by the applicable written rental or service agreement. Product warranties, if any, are limited to the written warranty or sale terms provided for the product. Do not modify, overload, climb, remove supports from or use fencing equipment contrary to instructions or its intended purpose.
7. Acceptable use
You may use the website only for lawful purposes. You must not interfere with its operation; attempt unauthorized access; introduce malicious code; scrape or copy content through automated means in a way that burdens the site; impersonate another person; or submit false, unlawful, abusive or misleading material.
8. Intellectual property
Unless otherwise stated, the website’s branding, text, photographs, videos, graphics, layout and code are owned by or licensed to M&S Fence and are protected by applicable intellectual-property laws. You may view and print reasonable portions for personal or internal project evaluation. Commercial reproduction, distribution, modification or use requires prior written permission.
9. Third-party links and services
The website may link to third-party websites, maps, social platforms or services for convenience. M&S Fence does not control and is not responsible for their content, availability, security, terms or privacy practices. Accessing them is at your own discretion.
10. Disclaimer
To the extent permitted by law, the website and its content are provided “as is” and “as available,” without representations, warranties or conditions of any kind, whether express or implied. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
11. Limitation of liability
To the extent permitted by law, M&S Fence and its owners, employees and service providers will not be liable for indirect, incidental, special, consequential or punitive loss arising from use of, or inability to use, the website. These website limitations do not replace the liability provisions in an applicable written quote, rental agreement, sale agreement or service contract, and do not limit liability that cannot lawfully be limited.
12. Governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. Subject to applicable consumer law, disputes concerning the website will be brought before the courts located in Ontario.
13. Severability and waiver
If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver of it.
14. Changes
We may update these Terms by posting a revised version with a new effective date. Continued use of the website after an update means you accept the revised Terms.
